How People Become Linked to Cybercrime Cases Through Bank Accounts, SIMs and Devices
Updated: Sep 12
A person may become connected to a cybercrime investigation through a bank account, UPI ID, SIM card, device, email address or online profile even when that person was not the caller or organiser of the alleged fraud.
The immediate task is to identify what digital or financial link brought the person's name into the record. Account ownership alone is relevant, but investigators and courts may also examine knowledge, control, benefit, conduct and the transaction trail.
Common ways people become linked to cybercrime cases
Lending or renting a bank account
A person may hand over account access, an ATM card, cheque book, registered mobile number or UPI credentials in return for a small payment. If fraud proceeds pass through that account, the account holder may face a debit freeze, police notice, questioning or an FIR.
Fake jobs and payment-processing work
Fraudsters sometimes recruit students, employees and job seekers to receive and forward payments as part of supposed online work. A commission or withdrawal instruction can later appear as part of the money trail.
Business payments from an unknown customer
A genuine seller or service provider may receive a payment that is later linked to a cyber-fraud complaint. In such a case, invoices, delivery proof, customer communications, tax records and the complete account statement become important.
SIM, KYC or device misuse
A SIM card, identity document, mobile device or remote-access application may be used by another person. The relevant questions include who possessed the device, who received OTPs, which IP address was used and who ultimately benefited.
Crypto, P2P and third-party transfers
P2P transactions, USDT trades and transfers made for another person may create several layers in the payment chain. Screenshots alone are rarely enough; the complete exchange record, wallet details, order history and bank trail should be preserved.
What investigators commonly examine
Who opened and operated the bank account or online profile.
Which device, SIM, IP address and registered number were used.
Whether money was retained, withdrawn, converted or forwarded.
Whether the account holder received a commission or other benefit.
Chats, calls and instructions connecting the person with other participants.
Whether the person reported misuse and cooperated after learning of the complaint.
Immediate steps after a police call, notice or bank restriction
Verify the police station, investigating officer, FIR or NCRP reference and the reason for contact.
Do not delete chats, reset devices, close accounts or create backdated documents.
Download complete bank statements and preserve transaction records.
Collect KYC, invoices, employment records, delivery documents and communications explaining the transaction.
Obtain a section-by-section legal assessment before making assumptions about arrest or bail.
Comply with lawful directions while preserving a clear written record of documents submitted.
A frozen account and arrest risk are separate questions
A lien or debit freeze does not automatically mean that the account holder is an accused or will be arrested. Conversely, removal of a bank restriction does not dispose of an FIR. The account remedy and the criminal-procedure strategy must be considered separately.
Available remedies depend on the stage
A factual representation to the bank or investigating officer with supporting documents.
A response to a police notice and participation in the investigation.
Anticipatory bail where a concrete apprehension of arrest exists for a non-bailable offence.
Regular bail after arrest or remand.
A court application for appropriate relief concerning a frozen account or lien-marked amount.

Frequently asked questions
Can an innocent account holder still receive a police notice?
Yes. A notice may be issued to obtain an explanation or records. The notice should be verified and answered with accurate documents. It does not by itself establish guilt.
Should the disputed amount simply be returned?
Do not make an informal payment without understanding the complaint, transaction trail and legal consequences. Any restoration or settlement step should be documented and legally assessed.
Can a person ignore a notice because the account was used by someone else?
Ignoring a lawful notice can worsen the position. The better course is to preserve evidence, obtain advice and respond through the appropriate process.
Does every mule-account allegation require anticipatory bail?
No. Arrest risk depends on the invoked sections, alleged role, amount, conduct, cooperation and other case-specific facts.
