Cybercrime bail is decided from the exact offences, the accused person's alleged role and the need for custody. The label cybercrime does not by itself answer whether an offence is bailable or non-bailable.

A single FIR may combine provisions of the Information Technology Act, 2000 with the Bharatiya Nyaya Sanhita, 2023. Bail strategy should therefore begin with a section-by-section reading of the FIR, complaint, remand report and available digital or banking record.

Start with the sections in the FIR

The following table gives a practical starting point. It is not a substitute for checking every section and any special statute mentioned in the case.

Provision

General classification

Practical point

IT Act Section 66C

Ordinarily bailable

Identity-theft allegation; knowledge and use of another person's identifying feature remain important.

IT Act Section 66D

Ordinarily bailable

Cheating by personation through a computer resource or communication device; Section 77B must be read with the punishment.

BNS Section 319(2)

Bailable

Cheating by personation; the alleged act and individual role must still be examined.

BNS Section 318(4)

Non-bailable

Cheating that dishonestly induces delivery of property; the alleged money trail and benefit become important.

Special statutes or additional offences

Case-specific

PMLA, UAPA, POCSO and other special laws may impose separate restrictions.

Regular bail and anticipatory bail are different remedies

  • Anticipatory bail under Section 482 BNSS is considered before arrest where there is a concrete apprehension of arrest for a non-bailable offence.

  • Regular bail is sought after arrest or remand in the particular FIR.

  • A bailable offence ordinarily carries a right to bail, but the required bond, sureties, identity documents and court formalities must still be completed.

  • Bail in one FIR does not automatically protect a person in another FIR arising from a different complaint.

What courts usually examine in a cybercrime bail matter

  • The exact role attributed to the applicant, rather than the broad allegation against the entire group.

  • Who controlled the bank account, mobile number, SIM, device, UPI ID, email address or online profile.

  • Whether the applicant received any financial benefit or commission.

  • The transaction trail, withdrawal pattern and connection with alleged beneficiaries.

  • Whether devices, records or disputed funds have already been secured.

  • Compliance with police notices and the need, if any, for further custodial interrogation.

  • Previous cases, connected complaints, residence, occupation and risk of absconding.

Documents that should be collected

  • FIR, complaint, police notice, arrest memo and remand report, as applicable.

  • Complete list of the BNS, IT Act and other provisions invoked.

  • Bank statements covering a reasonable period before and after the disputed transaction.

  • KYC and account-opening documents.

  • Unedited chats, emails, call details, invoices and employment or business records relevant to the alleged role.

  • Earlier bail orders and details of connected FIRs in Telangana or another State.

Hyderabad court and police jurisdiction

The correct forum depends on the police station, FIR, offence and territorial allocation. A Hyderabad City matter should not automatically be treated in the same way as a Cyberabad, Malkajgiri, Future City or other Telangana matter. The present jurisdiction and court assignment must be checked from the case record.

Frequently asked questions

Is every Section 66D IT Act case bailable?

Section 66D, read by itself with Section 77B of the IT Act, is ordinarily bailable. The complete FIR must still be checked for BNS Section 318(4), conspiracy, forgery or any other non-bailable provision.

Does a Section 35 BNSS notice guarantee that there will be no arrest?

Compliance with a lawful notice is important, but a police notice is not the same as a court order granting anticipatory bail. The notice, alleged offences and recorded reasons must be examined together.

Does bail remove a bank-account freeze?

No. Bail concerns personal liberty. A lien, debit freeze or seizure of funds generally requires a separate representation or court remedy.

Can bail be obtained only from the Telangana High Court?

Not necessarily. Depending on the offence, stage and jurisdiction, the competent Magistrate, Court of Session, Special Court or High Court may have a role.
